Paternity leave
Paternity leave is seven paid working days for a married male employee on the first four deliveries of his lawful spouse, under RA 8187, plus any days the mother transfers from her maternity leave.
Also called RA 8187
How it works
Paternity leave is short and specific. It is not a gender-neutral parental bank. The mother may allocate up to seven maternity days, so a qualified married father can see fourteen paid days in a live-birth case. Ask for the marriage and birth documents the statute expects. A U.S. ‘parental leave policy’ that ignores RA 8187 still leaves this due. For a U.S. company hiring one Filipino teammate, write this into the brief, the employment contract, and the peso payroll file before the start date. Slack habits do not override the Labor Code, BIR, or NPC. If the local employer of record holds the paper, they run the statutory step; you still owe a clean operating definition so the seat does not fail in week three. Put a number on the example when you budget loaded cost, because a nameless allowance always returns as a December surprise or a missed SLA.
Example: child born 10 May. Father takes seven RA 8187 days plus seven allocated maternity days. Coverage plan the inbox for two weeks, not one.
How it differs
Maternity leave is 105. Solo parent leave is another law. SIL can stack only if the person also has unused SIL and you allow it.
Common errors
Denying leave because the seat is remote. Treating a live-in partner as a spouse without checking the statute’s lawful-spouse language.
